The Colorado supreme court on Tuesday dismissed the latest lawsuit against Masterpiece Cakeshop owner Jack Phillips, who was accused in the most recent suit of discriminating against a transgender attorney by refusing to bake a gender-transition cake.

Scardina, who is also a Christian, pursued a discrimination claim against Phillips after he refused to bake the cake in 2017. She filed a claim under Colorado’s Anti-Discrimination Act, or CADA, which prohibits businesses from refusing services based on protected characteristics like race, religion or sexual orientation.

The baker at the center of the case was sued by an attorney after his bakery refused to make a cake to celebrate her gender transition.

The Colorado Supreme Court, by 4-3, declined to address the high-profile issue of a Christian baker's refusal to make a cake for a customer celebrating a gender transition, instead concluding the case was not properly filed in the first place.
